Your IRS-completed return, called a substitute for return (SFR), will almost always result in a higher tax debt than if you filed the return yourself. That's because when the IRS files an SFR, it will only grant you the standard deduction for a single taxpayer with no dependants, even if you normally file jointly, claim four dependants and itemize your deductions. The good news is some of these fines and fees may be mitigated simply by mailing in your late return. For example, the IRS has an unwritten rule that it will not criminally prosecute you if you mail in a late return before they contact you. (Civil late filing fees may still apply.) Additionally, if the IRS already completed an SFR for you, you may be able to reduce the amount of taxes owed simply by filing your old return and taking advantage of every deduction you are entitled to. Remember, since your fine is based on the amount of taxes you owe, it is extremely important to aggressively take every deduction legally available to you. Also keep in mind that when filing a late tax return, you must use the 1040 from that year, and go by the tax code that was in place for that year. For example, if you are filing a late return for 2008, you must complete a 2008 tax return and calculate your taxes based on the 2008 tax code. As with many tax matters, you may want to consult a tax professional to assist you with filing a late tax return. The previous interest rate was 6% (effective from April 1st to June 30th, 2008), and before that the rate was 7%. Interest as well as penalties are charged when a taxpayer has a balance due. For people on installment agreements, the lower interest rate will mean more of their monthly payment will go towards paying off their taxes.

If you owe taxes, the Internal Revenue Service will calculate penalties and interest on the amount owed. If you have a refund, the IRS may pay you interest on the delayed refund. Since most late tax returns take longer to process, the IRS "may" pay you interest on based on the extra amount of time it takes them to process your return.) If you have a refund, there is no penalty for filing late. Penalties are calculated on the amount due. Since there is no amount due, there is no penalty.

With 2009 nearly half over, the Internal Revenue Service reminds individual taxpayers there is no better time to check their 2009 federal income tax withholding levels to make sure they do not face any surprises when returns are due next spring.
The Making Work Pay Credit lowered tax withholding rates this year for 120 million American households. However, particular taxpayers who fall into any of the following groups should review their tax withholding rates to ensure enough tax is withheld: multiple job holders, families in which both spouses work, workers who can be claimed as dependents by other taxpayers and pensioners.
Failure to adjust your withholding could result in potentially smaller refunds or may cause you to owe tax rather than receive a refund next year. So far in 2009, the average refund amount is $2,675 and 79 percent of all returns received a refund.

ssing a deadline may not be that big of a deal. Just get your tax return filed as soon as you can.
Be aware of the late filing penalties. The IRS charges both interest and penalties if you have a balanced owed on your return. There's no penalty if you have a refund. Currently, penalties are 5% for each month (or part of a month) that your return is late, plus half-a-percent per month for paying late, plus interest which is currently running at 5% per year. Because of these penalties, it's better to file sooner rather than later to keep any penalties at a minimum.
April 15 has come and gone. Did you beat the deadline, or do you think you owe so you hope that the problem will go away. Well, bad news, the IRS has hired 40,000 new auditors and they need work so they will look at your non-filing and let you know about it. If you cannot pay the full amount of taxes you owe by the October 15 deadline, you should still file your return by the deadline and pay as much as you can to avoid penalties and interest. There are also alternative payment options to consider:

Hopefully your business will be profitable over the long run. But new businesses often encounter several years of losses before the business starts to be profitable. The biggest question you need to ask yourself is how you want to handle your business losses, and how you want to handle your business profits. This article assumes that your business is already profitable, or will become profitable in the near future. Deciding on a form of organization when your business is losing money is discussed in a separate article.
All of the forms of business organizations can be separated into two groups: corporations where tax is assessed at the corporate level and "pass-through entities" where tax is assessed at the shareholder level. The phrase "pass-through entity" means that profits are not taxed to corporation. Instead, 100% of profits (or losses) are distributed (or passed-through) to the shareholders. Each shareholder reports his or her share of profits or losses on his or her individual Form 1040.
Taxpayers who use e-file and who choose direct deposit can receive their refund in as few as 10 days. That's because with e-file, there's no paper return going to the IRS. IRS e-file allows taxpayers to file their returns now and pay later if they owe taxes. It allows taxpayers to file both federal and most state returns at the same time. And with direct deposit, there's no paper refund going to the taxpayer. So it’s all electronic and much faster than paper.
Here's the breakdown of the various types of organizations.
Taxed at the corporate level:
•Corporations,
•LLCs taxed as corporations, and
•Non-profit organizations
Taxed at the shareholder level ("Pass-through entities"):
•Schedule C sole proprietors,
•S-Corporations,
•Partnerships, and
•LLC/LLP/PLLC/PLLP taxed as partnerships
BACK TAX FILING
First things first, as the saying goes. You need to track down missing tax documents. This is usually accomplished by calling the IRS and asking them to mail or to fax you a "payer transcript" for the years you haven't filed. A payer transcript is a printout of information from W-2 forms, 1099 forms, and other tax documents filed with the IRS. This information is generally accurate and reliable. The payer transcript is limited, however. It does not contain any tax information related to the state (such as state income tax withholding). So, call your state tax agency to obtain any information about tax withholding.
What if you owe? Here's what you are facing. First, review the penalties: failure to file on time, failure to pay on time, and interest on the amount owed. Interest rates change every quarter, but you can guesstimate between 5% and 10% in annual interest. The late payment penalty is 0.5% (half of one percent) per month for each month your tax bill is not paid in full. Now for the biggie. The failure to file penalty is 5% of the tax due per month for each month the tax return is late, up to a maximum penalty of 25% of the tax due. You reach the maximum late filing penalty after just five months. (Note to future self: if you anticipate being late, file an automatic extension and a second extension. That will give you until October 15th to file a return.) So, using the example of a 2003 tax return with a balance due. You are already five months late, so add 25%. Add another 0.5% for every month you are late for the late payment penalty. (So, if you are 60 months late, that would be 60 x 0.5% equals 30%.) Plus add interest on the balance due for each year you are late (another 5% to 10% per year). On a five-year old tax return, this can easily double your balance due.
All the more reason to maximize those deductions on a late tax return. The smaller your balance due, the smaller your penalties.

Tax return due dates vary depending on what type of business organization you have chosen. Tax return due dates are different for the various types of business organizations.
Sole Proprietorships (unincorporated)
Sole proprietorships that are not incorporated file taxes with the owner’s personal tax returns. Their tax year, just like the owners, ended on December 31, 2008. They have until April 15, 2009 to file their federal and state tax return unless they file an extension.
Partnerships
A partnership return, Federal Form 1065, is an informational return since tax is owed by the individual partners. The tax year ended on December 31, 2008 and the return is due, along with the partner’s returns, on April 15, 2009. The partners file a K-1 return on April 15 which shows their share of the income or loss in the partnership.
Limited Liability Companies
Single-member limited liability companies file taxes like sole proprietorships. The tax year ended December 31, 2008 and the filing deadline is April 15, 2009. Multiple-member limited liability companies conform to the rules of partnerships stated above.
Corporations
A C-corporation may elect the end of their own fiscal or financial year. The corporation usually chooses the end of a quarter for the end of their fiscal year. If a corporation chooses the end of a quarter, taxes are due and payable the 15th of the third month after the end of that quarter. If the corporation, for example, chooses September 30 as the end of their fiscal year, then the corporation must file and pay their taxes by December 30 of that year.
Subchapter S Corporations
Since the profits or losses of a Subchapter S Corporation are claimed on individual returns, the tax year for this type of corporation usually ends on December 31. Like other corporations, Subchapter S Corporations have to file three months hence on the 15th day of the month, which would be March 15.
IRS Drops Interest Rate on Late Payments
Interest charged on balances owed on federal taxes will drop to 5% starting July 1, 2008. The previous interest rate was 6% (effective from April 1st to June 30th, 2008), and before that the rate was 7%. Interest as well as penalties are charged when a taxpayer has a balance due. For people on installment agreements, the lower interest rate will mean more of their monthly payment will go towards paying off their taxes.
IRS Tax Penalties
Filing & Owing is Better Than Not Filing & Owing
If you owe taxes, the Internal Revenue Service will calculate penalties and interest on the amount owed. If you have a refund, the IRS may pay you interest on the delayed refund. (Note the difference between "will" and "may" – the IRS generally pays interest on refunds that have been delayed because of slow processing by the IRS. Since most late tax returns take longer to process, the IRS "may" pay you interest on based on the extra amount of time it takes them to process your return.) If you have a refund, there is no penalty for filing late. Penalties are calculated on the amount due. Since there is no amount due, there is no penalty.
If you have a balance due on a late tax return, the IRS will calculate additional penalties and interest. There are three separate penalties:

• Interest
Each is calculated differently. Let's take a look at each one.
Failure to File Penalty
The failure-to-file penalty is calculated based on the time from the deadline of your tax return (including extensions) to the date you actually filed your tax return. The penalty is 5% for each month the tax return is late, up to a total maximum penalty of 25%. The percentage is of the tax due as shown on the tax return. If your tax return is more than five months late, simply multiply your balance due by 25% to calculate your failure to file penalty.
Failure to Pay Penalty
The failure-to-pay penalty is calculated based on the amount of tax you owe. The penalty is 0.5% for each month the tax is not paid in full. There is no maximum limit to the failure-to-pay penalty. The penalty is calculated from the original payment deadline (the original April 15th filing deadline) until the balance due is paid in full.
Interest
Interest is calculated based on how much tax you owe. Interest rates change every three months. Currently, the IRS interest rate for underpayment of tax is 5% per year. The interest is calculated for each day your balance due is not paid in full.
